Implementation scheme of pollutant discharge permit (《控制污染物排放许可制实施方案》（国办发〔2016〕81号）has been in effective on November 10, 2016, which has been recognized as one of the strictest requirements issued by China government.

According to the newly published law, a national cap and trade process will be taken as key steps in pollutants discharge area. All enterprise shall start from applying pollutants discharge permits. By end of 2016, enterprises in thermal power industry and Pulp and paper making industry shall apply for pollutants discharge permits. In year of 2017, enterprise in industries with over-capacity shall get permit, including petro chemical industry, chemical industry, steel industry, non-ferrous metals industry, concrete industry, painting industry, leather manufacturing industry, coking industry, plating industry, etc. Until year of 2020, enterprises in industries enrolled in the menu should have gotten permits.

Enterprise shall discharge pollutants according to the volume as well as types entitled in the permits. The government encourages enterprise to save pollutants discharge through pollution prevention and material efficiency. The saved pollutants discharge against the permits can be traded according to law issued in the future.

Enterprise will get administrative penalty (making amends, reducing capacity or shut the facility) as well as fine up to one million RMB if it does not apply pollutants discharge permits or over discharge pollutants on the permits.
